RELEASE OF LIABILITY

I HEREBY ASSUME ALL OF THE RISKS OF OPERATING AND/OR RIDING JUICED FAT TIRE ELECTRIC SCOOTERS, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event.

(1) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITY: JUICED SCOOTERS, LLC and/or their owners and employees.

(2) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise.

I acknowledge that this activity may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people.  The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

LIMITATION OF LIABILITY:

In no event shall Juiced Scooters, be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, even if Juiced Scooters, has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this site. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.

By owning or riding a Juiced Fat Tire Scooter you take on full liability for operating the scooter, maintenance and proper storage.  Juiced Fat Tire Scooters cannot be held liable for any injury, damage or accidents that occur on the scooters.  By purchasing a scooter you acknowledge full responsibility and cannot hold Juiced Scooters, LLC responsible for any damages, injuries or any loss.  Juiced Scooters are NOT intended to be ridden on the street and we can NOT be held responsible for how a scooter is operated.  Children under the age of 16 are NOT intended to use these scooters.  All rides must obey the rules that their city presents.  Juiced Scooters contain a lithium ion battery and must be handled properly.  We cannot be held liable for any damage from the use and storage of these batteries once a sale has been made since we cannot guarantee the proper environment once no longer in our possession.  It is your responsibility to read and understand the storage of these batteries.

Verification of information may be required prior to the acceptance of any order. By placing a credit card order, the customer grants the Juiced Scooters, permission to contact their bank to verify name and address.

OPERATING LIMITATIONS

​

• Riders must be 18+ years of age with a valid driver’s license

• Do not drink and ride

• No riding on sidewalks

• Do not block sidewalks and ramps

• Do not ride impaired or distracted

• Do not use a vehicle with more than two people

• Operators are responsible for following their state and/or city laws regarding scooters

• Scooters are not street legal and should not be operating on roads with vehicles

• If you choose to violate any laws while operating our scooters we will not be liable for any injury, tickets, fees or medical fees.

Juiced scooter assembles scooters, we are not the manufacturer of parts.  We will not be held liable for any part failure.  Use at your own risk.
